AFFILIATE PROGRAM TERMS AND CONDITIONS
AFFILIATE PROGRAM TERMS AND CONDITIONS
This agreement ("Agreement") sets forth the terms and conditions of participation in the Affiliate Program ("Program") operated by Waterman Corporate Enterprises Ltd, herein referred to as "Watermans" or "Company".
1. Acceptance of Terms and Conditions
By participating in the Program, the Affiliate ("you") accept all the terms and conditions set forth herein. Watermans reserves the right to update or modify this Agreement at any time without prior notice.
2. Affiliate Obligations
As an Affiliate, you agree to actively promote Watermans' products and services, and to comply with all the terms of this Agreement.
3. Restrictions on Promotion
3.1 You are expressly prohibited from promoting Watermans' products and services via Google Ads, Microsoft Ads, Meta Ads or any other paid ads and coupon sites. This includes the usage of any tracking or discount codes associated with the Program on these platforms.
3.2 Any attempt to violate this policy will result in immediate termination of this Agreement and the forfeiture of any earned commissions. You acknowledge and agree that in such an event, Watermans may remove and withhold any commission from your account without warning.
4. Commission and Payment
4.1 Commissions will be paid on a monthly basis. The exact payment schedule will be determined by Watermans.
4.2 Watermans reserves the right to review all commissions for possible fraud or violation of this Agreement. Any violation may result in the withholding of commissions and the termination of this Agreement.
5. Termination
5.1 Watermans reserves the right to terminate this Agreement at any time, for any reason. In the event of termination, you agree to immediately cease all promotion of Watermans' products and services, and to remove all links and promotional materials from your site(s).
5.2 Traffic from Google. Your account will be terminated immediately if we identify referral traffic reaching us directly from Google.com or any Google owned property. This includes Google Search, Google Ads, Google Shopping, Google Display, Google Business Profile and YouTube. It applies whether that traffic is paid or unpaid, and whether it was generated by you or by any third party acting on your behalf. Placing your affiliate link or discount code anywhere within a Google property is a breach of this Agreement.
5.3 Coupon, voucher and deal sites. Your account will be terminated immediately if your affiliate link or discount code appears on any coupon, voucher, promo code, cashback, deal or discount aggregator site, or is distributed through any browser extension or toolbar of that type. This applies whether you submitted the code yourself or allowed a third party to do so.
5.4 Use of your real name. You must enter your real, legal name in every name field and name placeholder used in the Program, including your sign up details, your payment details and any name shown alongside your discount code. Nicknames, brand names, initials, placeholder text and any false or misleading name are not permitted. We require this to verify your identity and to meet our payment, tax and anti-fraud obligations. If you do not use your real name, your account will be terminated instantly and all commissions will be forfeited in full, with no payment made to you.
5.5 Effect of termination under this section. Where we terminate your account under clause 5.2, 5.3 or 5.4, all commissions, whether already earned, pending or yet to be paid, are forfeited immediately, any outstanding balance on your account is cancelled, and no payment will be made to you. Our decision on these matters is final.
6. Indemnification
You agree to indemnify, defend, and hold harmless Watermans from any claims, damages, lawsuits, actions, or other costs (including legal fees) arising from your use of the Program, your violation of this Agreement, or your violation of any rights of a third party.
7. Governing Law
This Agreement and any dispute or claim arising out of or in connection with it shall be governed by and construed in accordance with the laws of United Kingdom.
By participating in the Program, you acknowledge that you have read this Agreement and agree to all its terms and conditions.
